War crimes

CLA’s policy on military personnel is that allegations of war crimes should be investigated by military police, prosecuted by military prosecutors, and heard by military courts. These should not fall within the jurisdiction of civilian courts.

The Military should decide on the code of conduct for military personnel, and for the conflict concerned.  This recognises that the code necessary for fighting guerilla forces could well be different from an army-to-army conflict. The Head of the Military should report to the Minister for Defence and should, on request, face a Sente enquiry.
